These Terms of Service ("Terms") govern your use of the GOGO Fleet platform operated by GOGO Fleet ("we," "us," or "our"). By creating an account or using our services, you agree to these Terms.
By accessing or using GOGO Fleet, you confirm that you are at least 18 years old, have the legal authority to enter into this agreement, and agree to be bound by these Terms. If you do not agree, do not use the platform.
GOGO Fleet provides fleet management software for independent vehicle rental operators. The platform includes tools for contract management, payment processing, renter communication, GPS tracking integration, and marketplace listings. We are a software platform only — we are not a party to any rental agreements between fleet owners and renters.
As a fleet owner using GOGO Fleet, you agree to:
GOGO Fleet requires a valid payment method on file. By providing payment information, you authorize us to charge applicable fees when billing begins. We will provide advance notice before any charges are applied. Payment processing is handled by Stripe and subject to Stripe's terms of service.
Rental payments between fleet owners and renters are processed directly through Stripe. GOGO Fleet is not responsible for failed payments, disputes, or chargebacks between fleet owners and renters.
You are solely responsible for the collection, storage, and use of renter personal data in compliance with applicable privacy laws. You must maintain your own privacy policy and provide renters with appropriate notice of data collection. You agree not to use renter data collected through the platform for any purpose other than managing your rental operations.
GOGO Fleet and its original content, features, and functionality are owned by GOGO Fleet and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the platform without our express written permission.
You may not use GOGO Fleet to:
GOGO Fleet is provided "as is" without warranties of any kind. To the maximum extent permitted by law, GOGO Fleet shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of revenue, data, or business opportunities.
GOGO Fleet is not responsible for disputes between fleet owners and renters, vehicle damage, accidents, traffic violations, or any other matters arising from rental operations conducted through the platform.
You agree to indemnify and hold harmless GOGO Fleet and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from your use of the platform, your violation of these Terms, or your rental operations.
We may suspend or terminate your account at any time for violation of these Terms, non-payment, or any other reason at our sole discretion. You may terminate your account at any time by contacting us. Upon termination, your right to use the platform ceases immediately.
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the platform after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Harris County, Texas.
